Police charge two with trespassing for exceeding store's customer limit

Police report the pair was asked to wait outside due to customer capacity limits but they refused

On July 18, 2020, at 1:37 p.m., members of the Huronia West Detachment of the Ontario Provincial Police (OPP) responded to a trespassing complaint in progress at a retail store in the Town of Elmvale.  

Two people entered the store and exceeded the store's policy for maximum number of customers at one time. An employee of the store explained the company's policy and asked the pair to leave for the time being. The pair became confrontational and were then refused service and directed to leave. They refused to leave the store and the employee called for police assistance.  

Officers located the two people and charged them both with failing to leave premises when directed, contrary to Section 2(1)(b) of the Trespass to Property Act.  

The OPP would like to remind the public that in addition to Provincial guidelines for the operation of businesses during this time, and recommendations from public health authorities, companies have the right to create their own policies to further limit the number of customers allowed in a store. In many cases, these policies are created to further enhance the safety of their employees and patrons.
