Collingwood driver charged with impaired near Sudbury

FRENCH RIVER - On June 5, 2021 at 1 a.m., members from the Nipissing West (Noëlville) Detachment of the Ontario Provincial Police (OPP) investigated a traffic complaint of a possible impaired driver on Highway 64 in the Municipality of the French River.

Police located the vehicle parked on the highway.

While speaking with the driver, it was determined the driver was impaired by alcohol. The driver was arrested and transported to Nipissing West (Sudbury) OPP Detachment for further testing.

Open liquor was seized from inside the vehicle.

As a result of the investigation, Liam Fitzpatrick, 36 years of age from Collingwood, was charged with:
    •    Operation while impaired - alcohol and drugs, contrary to section 320.14(1)(a) of the Criminal Code (CC)
    •    Operation while impaired - blood alcohol concentration (80 plus), contrary to section 320.14(1)(b) of the CC
    •    Novice driver - blood alcohol concentration above zero, contrary to section 44.1(3) of the Highway Traffic Act
    •    Having care or control of a motor vehicle with open container of liquor, contrary to section 32(1) of the Liquor Licence Act

The accused was released by way of an Undertaking and Provincial Offence Notices and is scheduled to appear at the Ontario Court of Justice on June 30, 2021 in Sudbury.

The accused was issued a 90-day administrative driver's licence suspension and the vehicle was impounded for 45 days.

This incident marks the 30th driver charged under the criminal impaired driving laws in the Nipissing West Detachment area in 2021.
